Hypothetical Backtest Results

All backtest results shown on OnlyETFs are hypothetical and based on historical data. Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. In fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program.

Past Performance

Past performance is not indicative of future results. The historical returns of any strategy, ETF, or portfolio shown on this platform do not guarantee, predict, or imply future performance. All investments carry risk, including the possible loss of principal.

Backtest Limitations

Backtested results do not account for transaction costs, slippage, market impact, taxes, management fees, or other costs that would reduce actual returns. Backtests are also subject to look-ahead bias and survivorship bias. Strategies that appear profitable in backtests may not be profitable in real trading.

No Recommendation

OnlyETFs does not recommend any specific ETF, portfolio strategy, or allocation. Any examples provided are for illustrative purposes only. You should consult with a qualified financial advisor before making any investment decisions.

Data Accuracy

While we strive to provide accurate and up-to-date pricing and financial data, OnlyETFs makes no warranty regarding the accuracy, completeness, or timeliness of the data. Price data is sourced from Yahoo Finance and Polygon.io and may contain errors or delays. Do not rely on this data for real-time trading decisions.

Limitation of Liability

In no event shall OnlyETFs, its founders, employees, or affiliates be liable for any investment losses, financial damages, or consequential damages arising from your use of this platform or reliance on any information provided herein.

Acceptance of Terms

By accessing or using OnlyETFs ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time; continued use of the Service constitutes acceptance of updated terms.

Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to terminate accounts at our discretion.

Subscription Plans and Billing

OnlyETFs offers Free, Hobby ($19/month), and Pro ($79/month) subscription tiers. Paid subscriptions are billed monthly in advance. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Permitted Use

You may use the Service for personal, non-commercial educational and analytical purposes only. You agree not to: resell or redistribute the Service; scrape, copy, or reproduce data from the platform in bulk; use automated tools to access the Service beyond normal API usage; attempt to reverse engineer the platform; or violate any applicable laws.

Intellectual Property

All content, software, algorithms, and materials on OnlyETFs are the property of OnlyETFs. and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit written permission.

User Content

Any portfolio configurations, watchlists, or data you input into the Service remain your property. By using the Service, you grant us a limited, non-exclusive license to process and store your data solely to provide the Service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLYETFS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless OnlyETFs. and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

Information We Collect

We collect information you provide directly, including: your name and email address when you register; payment information processed by Stripe (we do not store card numbers); portfolio tickers, configurations, and backtest parameters you create; and correspondence with our support team.

Automatically Collected Data

When you use the Service, we automatically collect usage data including pages visited, features used, timestamps, IP address, browser type, and device information. This data is used to improve the Service and diagnose technical issues.

How We Use Your Information

We use your information to: provide and maintain the Service; process payments and manage subscriptions; send transactional emails such as portfolio alerts (Pro plan) and account notifications; respond to support requests; and improve the platform. We do not sell your personal data to third parties.

Third-Party Services

We use the following third-party services that may process your data:

• Supabase— Database and authentication infrastructure
• Stripe— Payment processing — governed by Stripe's Privacy Policy
• Resend— Transactional email delivery
• Vercel— Hosting and serverless compute
• Yahoo Finance / Polygon.io— Market data (no personal data shared)

Cookies

We use essential cookies to maintain your authenticated session and remember your theme preference. We do not use advertising or tracking cookies. You can disable cookies in your browser settings, but this may prevent you from using certain features of the Service.

Data Retention

We retain your account data for as long as your account is active or as needed to provide the Service. If you delete your account, we will delete your personal data within 30 days, except as required by law or for legitimate business purposes such as fraud prevention.

Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or export your personal data. To exercise these rights, contact us at privacy@onlyetfs.com. We will respond within 30 days. EU/EEA residents have additional rights under GDPR.

Security

We use industry-standard security measures including TLS encryption in transit and encryption at rest via Supabase. All user tables use Row-Level Security (RLS) to ensure you can only access your own data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

Children's Privacy

The Service is not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us at privacy@onlyetfs.com and we will delete it promptly.

Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance of the updated policy.
